Terms of Service

These Terms of Service ("Terms") govern your access to and use of cincovolcanes.com (the "Site") and the guided mountaineering expeditions, Cinco Volcanes Challenge content, and adventure gear and apparel offered by Cinco Volcanes, a business operated by Andres Ortega ("Cinco Volcanes," "we," "us," or "our"). By accessing the Site, creating an account, or purchasing anything from us, you agree to these Terms. If you do not agree, do not use the Site.

1. Who Can Use the Site

You must be at least 18 years old to create an account, make a purchase, or book an expedition with us. Cinco Volcanes expeditions require all participants to be 18 or older, consistent with our Liability Waiver and Assumption of Risk Agreement.

2. Our Services

Cinco Volcanes offers:

• Guided mountaineering expeditions to Mexico’s volcanoes, including La Malinche, Sierra Negra, Nevado de Toluca, Iztaccíhuatl, and Pico de Orizaba
• Information about the Cinco Volcanes Challenge
• Adventure gear and apparel for sale

Expedition itineraries, routes, and guide decisions may change due to weather, altitude conditions, group fitness, or safety judgment. We do not guarantee that any participant will reach a summit.

3. Bookings, Payments, and the Liability Waiver

• Prices are listed in U.S. dollars and are subject to change until you complete a booking or purchase.
• Payments are processed through our platform’s payment processor. We do not store your full card number.
• Booking an expedition typically requires a deposit or reservation payment. Deposit amounts, payment schedules, and cancellation/refund terms are set out at checkout for each offer and in our Refunds & Cancellations Policy.
• Every expedition participant must read, sign, and submit our Liability Waiver and Assumption of Risk Agreement, and carry the travel/medical/evacuation insurance it requires, before participating. Mountaineering carries inherent risk of serious injury or death; the waiver and insurance requirement are conditions of participation, not formalities.
• You are responsible for your own fitness for high-altitude mountaineering, for any medical information you disclose, and for arranging your own travel to and from Mexico unless we state otherwise in your booking.

4. Gear and Apparel Purchases

• Product descriptions, images, and availability are provided as accurately as we can, but we do not guarantee that they are error-free.
• Shipping timelines and any return or exchange terms are provided at checkout or in a separate Shipping & Returns Policy where applicable.

5. Accounts

If the Site lets you create an account (for example, to access content or manage a booking), you’re responsible for keeping your login credentials confidential and for all activity under your account. Let us know right away if you believe your account has been accessed without authorization.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the Site, other users’ accounts, or our systems
• Interfere with or disrupt the Site’s operation
• Scrape, copy, or reproduce Site content for commercial purposes without our permission
• Impersonate any person or misrepresent your affiliation with Cinco Volcanes

We may suspend or terminate your access to the Site or a booking if we reasonably believe you’ve violated these Terms or put yourself or others at risk during an expedition.

7. Intellectual Property

The Site and its content — including text, graphics, logos, photos, and the Cinco Volcanes name and branding — belong to Cinco Volcanes or our licensors and are protected by copyright and trademark law. You may view and use the Site for personal, non-commercial purposes, but you may not reproduce, distribute, or create derivative works from our content without written permission.

8. Third-Party Links and Services

The Site may link to third-party websites or use third-party services (such as our hosting platform, payment processor, analytics, and advertising tools). We don’t control those third parties and aren’t responsible for their content, policies, or practices. Your use of third-party services is subject to their own terms.

9. Disclaimers

The Site and our Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t warrant that the Site will be uninterrupted, secure, or error-free.

Nothing in these Terms limits, replaces, or reduces the assumption of risk, release of liability, and indemnification you agree to in the separate Liability Waiver and Assumption of Risk Agreement for expedition participation. Where the two documents address the same subject for an expedition, the Liability Waiver controls.

10. Limitation of Liability

To the fullest extent permitted by law, Cinco Volcanes and Andres Ortega will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or our Services. Our total liability for any claim arising out of these Terms or our Services will not exceed the amount you paid to us in the twelve months before the claim arose. This section does not limit liability for death or personal injury caused by our gross negligence or willful misconduct, to the extent such limitation is not permitted by law.

11. Indemnification

You agree to indemnify and hold Cinco Volcanes and Andres Ortega harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your participation in an expedition, except to the extent caused by our own negligence or willful misconduct.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles, consistent with our Liability Waiver. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent changes. Continuing to use the Site after changes take effect means you accept the updated Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the rest of the Terms remain in effect. Together with our Privacy Policy and, for expedition participants, our Liability Waiver and Assumption of Risk Agreement, these Terms make up the entire agreement between you and Cinco Volcanes regarding the Site and our Services.
